Using PupMarks

Terms of Service

These Terms set the ground rules for accounts, location features, dog and community content, sharing, and safe use of PupMarks.

Important points

  • You must be at least 18 to use PupMarks.
  • Owner features do not require a business subscription; paid business tools are optional.
  • You control what you post, but public and share-link content can be copied by others.
  • Map, GPS, nearby, pet-care, and safety information can be incomplete or inaccurate and is not emergency, navigation, or veterinary advice.
  • Do not use PupMarks to stalk, harass, expose private locations, impersonate others, scrape data, or interfere with the service.
  • We have zero tolerance for violent, sexual, hateful, abusive, or animal-cruelty content. It is removed and can lead to immediate account termination.
  • We may use automated tools, including artificial intelligence, to help review content.

1. Agreement to these Terms

These Terms are an agreement between you and Nestory LLC, the operator of PupMarks. By creating an account, accessing the mobile application, or using a PupMarks feature, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the service.

You must be at least 18 years old and legally able to enter this agreement. If you use PupMarks for a business or organization, you represent that you have authority to bind it.

2. Accounts and accurate information

You are responsible for your account, sign-in credentials, devices, and activity performed through your account. Provide accurate information, keep your contact details current, and notify support@pupmarks.com if you suspect unauthorized access.

Do not share authentication tokens or attempt to transfer an account except through a PupMarks feature that expressly supports a dog, business, or role transfer. You are responsible for having authority to create profiles and records for the dogs, businesses, or care relationships you add.

3. What PupMarks provides

PupMarks can provide dog profiles, walk recording, PupMarks, maps, Pup Diary and recap views, follows, public or follower-visible sharing, reports and blocks, walker or care-team workflows, pet-care records, notifications, and business features. Features may vary by platform, account, location, test group, or release.

We may change, limit, suspend, or discontinue features to improve the product, protect users, comply with law, or operate the service. We do not promise that every feature will always be available or that changes made on your device are saved to your account until the app finishes syncing.

Owner features are available without a business subscription. Eligible business users may purchase an optional, auto-renewing PupMarks Business Subscription through Apple App Store or Google Play for a public storefront, promoted map pin, rewards, offers, and team tools. Before confirmation, the store purchase screen shows the current localized price, billing period, trial eligibility and duration, and renewal terms. Unless canceled, an eligible free trial converts to the paid monthly plan and the subscription then renews automatically at the store-displayed price. You can restore, manage, or cancel through the app and the applicable store. Deleting your PupMarks account or the app does not cancel a store subscription; cancel it through Apple or Google Play to avoid future charges. Store rules and applicable law govern billing, cancellation timing, and refunds.

4. Location, map, pet-care, and safety limitations

GPS, device sensors, network conditions, map data, user submissions, and approximate-location processing can be delayed, incomplete, or wrong. Do not rely on PupMarks for emergency response, turn-by-turn navigation, property boundaries, proof of presence, recovery of a missing dog, or a person's real-time safety.

Live sharing and nearby content are convenience features, not monitoring services. Keep control of your dog, follow local rules, respect private property, and independently assess people, dogs, businesses, routes, weather, traffic, and hazards.

Vaccination, grooming, timeline, vet-verification, and other pet-care records are organizational tools. PupMarks does not provide veterinary, medical, legal, insurance, or professional advice. Consult a qualified professional for care decisions.

5. Your content and sharing choices

You retain ownership of content you submit. You grant Nestory LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt for technical delivery, and display that content only as needed to operate, secure, improve, and provide PupMarks according to your settings and these Terms. This license ends when the content is deleted from active systems, except for retained records described in the Privacy Policy and copies others lawfully kept.

You represent that you have the rights and permissions needed to upload the content and to identify or depict any person, dog, place, business, or record included in it. Do not upload confidential records, precise locations, or images you are not authorized to share.

When you choose Nearby/public visibility or create a public share link, the content can be viewed without an approved follow relationship and may be copied, screenshotted, or redistributed. When you explicitly share a private or follower-only item to another app, its visual card can still show the photo, note, dog identity, PupMark type, and the location presentation you selected. The recipient must have access to open the restricted live PupMark, but they can still copy or forward the visual you chose to send. Revoking a link or changing visibility cannot retrieve copies or previously saved URLs held by another person.

6. Acceptable use

You may not:

  • Use PupMarks to stalk, harass, threaten, exploit, discriminate against, or expose the private location of another person or animal.
  • Impersonate another person, misrepresent ownership or authority, submit fraudulent verification material, or create deceptive accounts.
  • Post illegal, abusive, dangerous, infringing, sexually exploitative, malicious, or privacy-invasive content.
  • Scrape, harvest, bulk-download, enumerate, sell, or build profiles from users, dogs, routes, locations, tokens, or content.
  • Probe, bypass, or defeat authentication, visibility, rate, storage, moderation, safety, or access controls.
  • Upload malware, non-image files through image features, or content intended to disrupt or burden PupMarks or its providers.
  • Reverse engineer or copy the service except where applicable law expressly permits it.
  • Use the service in a way that violates law, another person's rights, or these Terms.

7. Content standards and zero tolerance

PupMarks is a place for dogs and the people who love them. We have zero tolerance for objectionable content. The content below is not accepted anywhere on PupMarks, including photos, captions, notes, dog and business profiles, usernames, comments, and messages, and it will never be accepted, whatever its visibility setting:

  • Violence and gore: violence against people or animals, threats, graphic injury, blood, or death, and content that glorifies, encourages, or makes light of harm.
  • Animal cruelty and neglect: abuse, neglect, dog fighting or other animal fighting, and content that promotes or celebrates harming an animal. Memorial photos of a pet who has passed are welcome when they are not graphic.
  • Sexual content and nudity: pornography, nudity, sexually explicit or suggestive material, and anything that sexualizes a person or an animal.
  • Child safety: any content that sexualizes, exploits, or endangers a minor. We report apparent child sexual exploitation to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement.
  • Hate and harassment: hate speech, slurs, or attacks based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age, or similar characteristics, and bullying, intimidation, or targeted harassment.
  • Violent extremism: content that supports or promotes terrorism, violent extremist groups, or mass violence.
  • Self-harm: content that promotes or encourages suicide, self-harm, or eating disorders.
  • Illegal and dangerous activity: promoting or arranging illegal activity, including illegal sale of animals, drugs, or weapons.
  • Privacy violations: another person's home address, precise location, contact details, or personal records shared without their permission.
  • Spam, scams, and deception: fraud, phishing, misleading offers, fake reviews, and repetitive or unsolicited promotion.

We remove content that breaks these standards when we find it. Depending on severity, we may also restrict features or suspend or permanently terminate the account without prior warning, preserve relevant records, and notify law enforcement. Severe violations, including child exploitation, credible threats of violence, and animal cruelty, lead to permanent termination.

8. Reports, moderation, and enforcement

PupMarks provides reporting and blocking tools, but we do not pre-screen every submission or guarantee that all objectionable content will be removed. We may review reports and relevant records, limit visibility, revoke shares, remove content, restrict features, suspend accounts, preserve evidence, or notify appropriate authorities when reasonably necessary for safety, security, legal compliance, or enforcement.

We may use automated tools, including artificial intelligence (AI) systems operated by us or our service providers, to help detect, flag, and review content that may break these Terms, such as photos, captions, notes, and profile information. Automated tools can make mistakes, so flagged content may also be reviewed by authorized people. The Privacy Policy explains how automated analysis, AI, and human moderation handle your information.

False, abusive, or retaliatory reports may themselves violate these Terms. If you believe an action was taken in error, contact support with the account and content details needed for review.

9. Third-party and platform services

PupMarks depends on services supplied by third parties, including cloud infrastructure, map, analytics, AI, subscription management, and email providers, Apple, Google Play, device operating systems, networks, and other providers. Apple or Google processes in-app subscription purchases, and a subscription service provider helps PupMarks present, restore, manage, and reconcile subscription status. Their availability and independent terms may affect PupMarks. We are not responsible for third-party content, services, stores, maps, or policies that we do not control.

Links to third-party sites are provided for convenience and do not imply endorsement. Your use of those services is governed by their terms.

10. Account deletion and termination

You may stop using PupMarks at any time and may request deletion through Account controls in the app or on the Delete account page of this website. Deleting the app does not delete the account, and deleting the account does not cancel an Apple App Store or Google Play subscription.

We may suspend or terminate access when reasonably necessary to address a violation, safety or security risk, legal requirement, nonpayment for paid features, or service discontinuation. Provisions that by their nature should survive, including ownership, retained-record permissions, disclaimers, limitations, and dispute-related terms, continue after termination.

11. Disclaimers and limits

To the fullest extent permitted by applicable law, PupMarks is provided “as is” and “as available.” Nestory LLC disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted operation, perfect synchronization, accurate maps or GPS, reliable notifications, permanent availability of content, or any particular outcome from use of the service.

To the fullest extent permitted by applicable law, Nestory LLC and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, opportunity, or use arising from PupMarks. Nothing in these Terms excludes liability that cannot legally be excluded or limits non-waivable consumer rights.

Physical and animal safety remains your responsibility. PupMarks does not supervise walks, walkers, businesses, dogs, routes, or interactions and is not an emergency service.

12. Changes to these Terms

We may update these Terms when the service or legal requirements change. We will update the date above and provide additional notice when a change is material. Continuing to use PupMarks after updated Terms take effect means you accept them, where permitted by law.
